State Sen. Sydney Batch’s recently introduced bill seeks to boost capital access for small businesses by creating new state-run programs and enhancing investment incentives, the North Carolina State Senate records show.

The legislation, filed April 30 as SB 1056 in the 2025 regular session, carries the short title: ‘NC Small Business Capital & Jobs Act.’

In summary, the bill establishes the North Carolina Small Business Capital Access Act. It creates an office and an oversight board within the Department of Commerce to administer a statewide program increasing access to capital for small and underserved companies. Components include loan guarantees, an equity and growth fund, grants and loans for CDFIs, technical assistance statewide, financing tools for state procurement, and an innovation fund connected to SBIR and STTR programs and regional hubs. The bill also brings back and expands investment tax credits, increases the yearly credit limit to $10 million, and sets an appropriation of $50 million annually beginning with fiscal year 2026-27. North Carolina’s legislative process for bills involves several stages before a proposal can become law. After a lawmaker files a bill, it is sent to a committee for evaluation. The bill must then pass three readings in both chambers. Should there be amendments after passage by either chamber, both must agree on one final version. The bill moves to the governor next, who has 10 days (or up to 30 when the legislature is out of session) to sign, veto or allow it to become law without signature.
